Archbee Privacy Policy

This Archbee Privacy Policy (“Policy”) describes how AiurLabs, Inc. DBA Archbee (“AiurLabs”, “we,” or “us”) collects, uses and discloses your personal information. This Policy applies to information we collect when you use our websites, mobile applications and other online products and services where this Policy is posted (collectively, the "Services").

We may change the provisions of this Policy at any time and will indicate when changes have been made by revising the date at the top of this Policy. Your use of the Services, or any portion thereof, following the posting of such changes shall constitute your consent to such changes. We encourage you to review the Policy whenever you access the Services to make sure that you understand our information collection, use and disclosure practices. If we make material changes to this policy, we will provide you with additional notice of such changes and request your affirmative consent before using or sharing previously collected information in a materially different way.

Information That You Provide to Us

Archbee may collect information that you provide when you use the services, such as when you: (1) create an account; (2) make a purchase; (3) participate in events or promotions; (4) send questions or comments via e-mail or live chat to Archbee customer support; (5) submit your resume to us online; (6) fill out surveys; or (7) otherwise communicate with us through the Services. The types of personal information that you provide may include your name, e-mail address, telephone number, postal address, credit card information, and other contact or identifying information that you choose to provide.

Content. Archbee stores, processes and maintains files that you create and/or upload using the Services (as well as previous versions of your files), including Archbee charts that you create, sharing lists, and other data related to your account in order to provide the service to you.

Information That We Collect Automatically From You

Account activity. Archbee servers automatically record certain information about your use of Archbee. Similar to other web services, Archbee uses both permanent and session cookies, web beacons, and pixel tracking technology to record information such as account activity (e.g., storage usage, number of log-ins, actions taken), data displayed or clicked on (e.g., UI elements, links), other log information (e.g., browser type, IP address, date and time of access, cookie ID, referrer URL, etc.), and to remember user preferences while using the services. Archbee may collect automated error reports in the case of software malfunction; such error reports may contain some or all of the information in your documents and may be reviewed to help resolve problems with the Archbee software or service.

Information We Collect From Third Parties

We may obtain information from other sources and combine that with information we collect through our Services. For example, if you create or log into your account through a third-party social networking site, we will have access to certain information from that site, such as your name, account info and friends, in accordance with the authorization procedures determined by such third-party social networking site.

If you elect to purchase a license to use Archbee, we may receive information about your purchase from our third-party payment processor.

We use analytics services and software provided by third parties to help us understand how users access and use the Services. These tools and services place cookies, web beacons and other devices or technologies on our Services to enable them to track traffic data. The data collected typically includes information such as your IP address, your Internet Service Provider, your web browser, the time spent on webpages, the links clicked and the advertisements viewed on those pages. We use this information to improve our Services and your experience, to see which areas and features of our Services are popular and to count visits.

We may display advertising to you on our site that is provided by third parties.

How We Use Your Information

We use personal information collected through Archbee services for purposes described in this Policy or otherwise disclosed to you on or in connection with our services. For example, we may use your information to:

Files you create, upload, or copy to Archbee may, if you choose, be read, copied, used and redistributed by people you know or, again if you choose, by people you do not know. Information you disclose using the chat function of Archbee may be read, copied, used and redistributed by people participating in the chat. Use care when including sensitive personal information in files you share or in chat sessions, such as social security numbers, financial account information, home addresses or phone numbers.

Some features may be provided by third parties (e.g. the payments processing services such as Stripe).

Archbee reserves the right to review documents to help resolve problems with the Archbee software or service, or to ensure compliance with our Terms of Service.

Information Sharing

Archbee may share your personal information with third parties in the following limited circumstances:

We may share with third parties certain pieces of aggregated, non-personal information, such as the number of users who used a type of document, for example, or how many users clicked on a particular advertisement. Such information does not identify you individually.

In connection with, or during negotiations of, any merger, sale of some or all of Archbee assets, bankruptcy or reorganization, financing or acquisition of all or a portion of Archbee business to another company.

Data Security

Archbee takes reasonable measures to protect your personal information and your documents from loss, misuse and unauthorized access, disclosure, alteration and destruction and to ensure that your documents remain available to you.

You have the right to access your information that Archbee has collected from you. You may do so by contacting Archbee using the “Contact Us” information below or through the Company’s designated dispute resolution provider. You have the right to limit the use and disclosure of your personal data by not providing said information to Archbee or by not using the Archbee Services. You may request that AiurLabs correct, amend, or delete your information where it is inaccurate, or has been processed in violation of the Principles, except where the burden or expense of providing access would be disproportionate to the risks to your privacy in the case in question, or where the rights of persons other than the individual would be violated.

Data Privacy Framework

AiurLabs, Inc. has certified to the U.S. Department of Commerce that AiurLabs adheres to (1) the EU-U.S. Data Privacy Framework with regard to the processing of personal information received from the European Union, (2) the UK Extension to the EU-U.S. Data Privacy Framework, with regard to the processing of personal information received from the United Kingdom (and Gibraltar), and to (3) the Swiss-U.S. Data Privacy Framework with regard to the processing of personal information received from Switzerland (the “DPF”). The Federal Trade Commission has jurisdiction over our compliance with the DPF.

We remain responsible for all the personal information we receive under the DPF and that we subsequently transfer to third parties acting as agents on our behalf if they process personal information in a manner inconsistent with the DPF principles, unless we prove we are not responsible for the event giving rise to the damage.

If there is any conflict between the terms in this privacy policy and the EU-U.S. DPF Principles and/or the Swiss-U.S. DPF Principles, the Principles shall govern. To learn more about the DPF program, and to view our certification, please visit https://www.dataprivacyframework.gov/ .

If you have any question about our practices in relation to our participation in the DPF, or should you have any complaint in that regard, we encourage you to contact us directly, as set forth below. For any complaint that we cannot resolve directly AiurLabs, Inc. commits to cooperate and comply respectively with the advice of the panel established by the EU data protection authorities (DPAs) (for personal information received under the EU-US DPF), the UK Information Commissioner’s Office (ICO) and the Gibraltar Regulatory Authority (GRA)  (for personal information received under the UK Extension to the EU-US DPF), and the Swiss Federal Data Protection and Information Commissioner (FDPIC) (for personal information received under the Swiss-US DPF). In compliance with the EU-U.S. DPF and the UK Extension to the EU-U.S. DPF and the Swiss-U.S. DPF, AiurLabs, Inc. commits to refer unresolved complaints concerning our handling of personal data received in reliance on the EU-U.S. DPF and the UK Extension to the EU-U.S. DPF and the Swiss-U.S. DPF to JAMS, an alternative dispute resolution provider based in the United States, the European Union, the United Kingdom, and/or Switzerland (as applicable).  If you do not receive timely acknowledgment of your DPF Principles-related complaint from us, or if we have not addressed your DPF Principles-related complaint to your satisfaction, please visit https://www.jamsadr.com/DPF-Dispute-Resolution  for more information or to file a complaint. The services of JAMS are provided at no cost to you.

In compliance with the EU-U.S. DPF and the UK Extension to the EU-U.S. DPF and the Swiss-U.S. DPF, AiurLabs, Inc. commits to cooperate and comply respectively with the advice of the panel established by the EU data protection authorities (DPAs) and the UK Information Commissioner’s Office (ICO) and the Swiss Federal Data Protection and Information Commissioner (FDPIC) with regard to unresolved complaints concerning our handling of human resources data received in reliance on the EU-U.S. DPF and the UK Extension to the EU-U.S. DPF and the Swiss-U.S. DPF in the context of the employment relationship.

Your Choices

You may terminate your use of AiurLabs at any time.

General: You have the right to object to or opt out of certain uses of your information. Where you have consented to the processing of your information for a specific purpose, you may withdraw that consent at any time by contacting us as described below. 

Email Communications: If you receive an email from us and do not want to receive future emails from us, you can use the unsubscribe link found at the bottom of the email to opt out of receiving future emails. Note that you will continue to receive transaction-related emails regarding products or services you have requested. We may also send you certain non-promotional communications regarding us and our Services, and you will not be able to opt out of those communications (e.g., communications regarding the Services or updates to this Privacy Policy).

Mobile Devices: We may send you push notifications through our Apps. You may at any time opt out from receiving these types of communications by changing the settings on your mobile device. With your consent, we may also collect precise location information if you use our Apps. You may opt out of this collection by changing the settings on your mobile device.

Cookies: Most web browsers are set to accept cookies by default. You can usually choose to set your browser to remove or reject browser cookies. Removing or rejecting browser cookies does not necessarily affect third-party flash cookies used in connection with our Services. Please note that if you choose to remove or reject cookies, this could affect the availability and functionality of our Services.

Access and control your information

You have certain choices available to you when it comes to your information. Below is a summary of those choices, how to exercise them and any limitations.

Access and update your information: Our Services and related documentation give you the ability to access and update certain information about you from within the Service. For example, you can access your profile information from your account and search for content containing information about you using key word searches in the Service.  You can update your profile information within your profile settings and modify content that contains information about you using the editing tools associated with that content.

Deactivate your account:   If you no longer wish to use our Services, you or your administrator may be able to deactivate your Services account. If you can deactivate your own account, that setting is available to you in your account settings. Please be aware that deactivating your account does not delete your information; your information remains visible to other Service users based on your past participation within the Services.  For more information on how to delete your information, see below.  

Delete your information: Our Services and related documentation give you the ability to delete certain information about you from within the Service. For example, you can remove content that contains information about you using the key word search and editing tools associated with that content, and you can remove certain profile information within your profile settings. Please note, however, that we may need to retain certain information for record keeping purposes, to complete transactions or to comply with our legal obligations.   

Request that we stop using your information:  In some cases, you may ask us to stop accessing, storing, using and otherwise processing your information where you believe we don't have the appropriate rights to do so.  For example, if you believe a Services account was created for you without your permission or you are no longer an active user, you can request that we delete your account as provided in this policy.  Where you gave us consent to use your information for a limited purpose, you can contact us to withdraw that consent, but this will not affect any processing that has already taken place at the time.
